Terms of Service

Please read these Terms of Service carefully before using the PKAILA platform. By creating an account or placing an order, you confirm that you have read, understood, and accepted these Terms in full.
1. Parties
These Terms of Service govern the relationship between:
WORKIT DOIT — registered business in Israel (עוסק מורשה), operator of the PKAILA platform

Delespot SAS — a simplified joint-stock company registered in France, acting as authorized payment agent on behalf of WORKIT DOIT

And the User: any individual or legal entity accessing and using the PKAILA platform.
Note on billing: Payments on the PKAILA platform are collected by Delespot SAS as payment agent on behalf of WORKIT DOIT. Invoices are issued by Delespot SAS in the name and on behalf of WORKIT DOIT.
2. Purpose
These Terms define the conditions under which WORKIT DOIT provides Users with access to PKAILA, an AI-powered video and cinematic content production platform. If you do not accept these Terms, please do not use the service.
3. Description of Service
PKAILA is a SaaS platform for AI-assisted video and advertising content production. The service includes:
- Automated generation of advertising storyboards and brand content via AI agents
- Creation of creative briefs, scripts, and art direction notes
- AI visual content production for personal and corporate branding
- Access to a multi-agent pipeline dedicated to cinematic production
- Project management and asset storage in a dedicated workspace
WORKIT DOIT reserves the right to evolve the features of the service at any time, including to improve output quality and integrate new AI capabilities.
Availability
PKAILA aims to maintain service availability 24/7. However, interruptions may occur for maintenance, updates, or due to force majeure. WORKIT DOIT shall not be held liable for service interruptions beyond its reasonable control.
4. User Account
Account Creation
Full access to PKAILA requires the creation of a personal account. You agree to provide accurate, complete, and up-to-date information at registration.
Account Security
You are solely responsible for keeping your login credentials confidential. Any use of your account — whether by you or a third party who has obtained access to your credentials — is your responsibility. If you suspect unauthorized access, notify us immediately at security@pkaila.com.
One Account Per User
Each User may hold only one account. Accounts are non-transferable.
5. Subscriptions and Credits
Subscription Plans
PKAILA offers access to its service through monthly or annual subscription plans. Available plans, pricing, and included features are detailed on the pricing page at pkaila.com/pricing.
Credit System
The service operates on a credit-based system. Each content generation (storyboard, brief, visual assets, etc.) consumes a defined number of credits based on production complexity.
- Credits included in a subscription plan are renewed each month on the subscription anniversary date
- Unused credits do not roll over to the following month, unless otherwise specified in higher-tier plans
- Additional credits may be purchased separately outside of the subscription
- Separately purchased credits are valid for 12 months from the date of purchase
Important: Credits acquired through a subscription or a separate purchase are non-refundable and non-exchangeable, except where required by law in your country of residence.
6. Payment and Billing
Payment Collection
Payments on the PKAILA platform are processed by Delespot SAS as authorized payment agent, via Stripe’s secure payment infrastructure. Your banking data does not transit through WORKIT DOIT’s servers. Stripe is PCI-DSS Level 1 certified.
Billing Terms
Subscription billing is processed in advance (monthly or annually) by automatic charge. You will receive a receipt by email at each billing cycle, issued by Delespot SAS on behalf of WORKIT DOIT.
Currency and Taxes
Prices are displayed in USD or EUR depending on your region. Prices are exclusive of applicable taxes. Any applicable VAT or local tax will be added to the invoiced amount in accordance with the regulations of your country of residence.
Failed Payment
In the event of a failed payment, WORKIT DOIT reserves the right to suspend access to the service after prior notice. If the situation is not resolved within 7 days following notification, the account may be terminated.
Refunds
Users residing in the European Union have a 14-day right of withdrawal from the date of subscription, provided the service has not been used. Beyond this period, no partial refund for the current billing period will be issued.
7. Intellectual Property
WORKIT DOIT’s Rights
The PKAILA platform, its software architecture, AI agents, interface, design, trademarks, and all editorial content are the exclusive property of WORKIT DOIT and are protected by applicable intellectual property laws.
AI-Generated Content
Creative content generated by the platform (storyboards, scripts, briefs, visual assets) from User inputs is made available as follows:
- Starter and Pro plans: A commercial use license is granted to the User for generated content within their personal and professional projects. WORKIT DOIT reserves the right to use these outputs for service improvement and anonymized demonstration purposes.
- Studio plan: Full rights to generated outputs are assigned to the User. WORKIT DOIT waives any use of outputs without prior agreement.
User-Provided Content
You retain full ownership of any content you upload to the platform (briefs, images, logos, etc.). By uploading content, you grant WORKIT DOIT a limited, non-exclusive, revocable license strictly necessary to deliver the service.
8. Acceptable Use
You agree to use PKAILA in compliance with applicable laws and these Terms. The following are expressly prohibited:
- Generating unlawful, defamatory, discriminatory, obscene, or rights-infringing content
- Using the service to circumvent third-party copyrights or reproduce protected works without authorization
- Attempting to bypass platform technical limitations or access the underlying AI systems
- Reselling access to the platform or credits without prior written agreement from WORKIT DOIT
- Abusively automating requests to the detriment of other users
- Using the service for generating disinformation, non-consensual deepfakes, or manipulation
Any breach of these rules may result in immediate account suspension without notice or refund.
9. Limitation of Liability
PKAILA is a creative assistance tool. AI-generated content is provided for guidance purposes and requires human review before any professional or commercial use.
WORKIT DOIT does not warrant:
- The complete absence of errors or inaccuracies in generated content
- The absolute originality of outputs (Users are responsible for verifying the absence of rights conflicts)
- The suitability of content for any particular commercial purpose
To the extent permitted by applicable law, WORKIT DOIT’s total liability to the User is capped at the amounts actually paid by the User during the 3 months preceding the triggering event.
10. Termination
By the User
You may cancel your subscription at any time from your account management settings. Cancellation takes effect at the end of the current billing period. Remaining credits are forfeited at the effective date of cancellation.
By WORKIT DOIT
WORKIT DOIT reserves the right to terminate or suspend access to the service in the event of a breach of these Terms, with prior notice except in cases of emergency or serious violation.
Effect of Termination
Upon termination, access to your account is closed. You have 30 days to export your data. After this period, data is deleted in accordance with the Privacy Policy.
11. Modifications
WORKIT DOIT reserves the right to modify these Terms at any time. Changes take effect 30 days after publication on the site, except in cases of legal or regulatory urgency. You will be notified by email of material changes. Continued use of the service after the new terms take effect constitutes acceptance.
12. Governing Law and Disputes
These Terms are governed by Israeli law. However, Users residing in the European Union retain the benefit of mandatory consumer protection rules under the law of their country of residence.
In the event of a dispute, you are encouraged to first contact WORKIT DOIT at legal@pkaila.com to seek an amicable resolution. EU-based Users may also use the European Commission’s Online Dispute Resolution platform: ec.europa.eu/consumers/odr
